Khan along with two other co-accused was arrested on December 3, 2011, on refusal of his bail plea by a special judge central under the allegation of causing six billion rupees loss to the National Police Foundation (NPF) during the period of 1997 to 2003 on the account of different agreements with the foundation. Citing the state as respondent, Advocate Tanveer Iqbal, counsel for Khan, submitted before the court that his client was under treatment in Pakistan Institute of Medical Sciences (PIMS). He said the case against his client was false and baseless who was also suffering from mitral and aortic valve disease and presently admitted in PIMS due to severe pulmonary hypertension and atrial fibrillation.
He stated it is the settled legal proposition that bail is not to be withheld as punishment, adding the object of criminal prosecution is not to punish an accused person for the offence alleged against him but to make him face the trial and answer the criminal charges against him. He informed the court that co-accused Khuda Bakhs and Chaudhry Iftikhar Ahmad Khan had already been allowed post-arrest bail by the special judge central.
He prayed to the court to accept his petition and grant his client post-arrest bale till final decision of the case.

The complainant in his application told the FIA that he, along with other 8 people, gave Rasool Rs 9, 45000 (Rs 10, 5000 each) and passports for sending them to the Kingdom of Saudi Arabia to perform Hajj. However, Rasool confiscated the passports of the nine people and did not send them to perform Hajj.
