Two separate applications were submitted with the apex court on Saturday – one seeking the closure of Mansoor Ijaz’s evidence for his failure to appear before the judicial commission and the other requesting the court to direct the commission to record his evidence anywhere outside Pakistan.
Watan Party chief Barrister Zafarullah filed the application, asking the court to close the evidence of Mansoor Ijaz, one of the main characters in the memo case, for not appearing before the commission.
He asked the court that a statement of the Inter-Services Intelligence (ISI) director general be recorded instead.
In his petition sent to the court through a courier service, Zafarullah said Ijaz was befooling the people of Pakistan, as he had not appeared before the court in three consecutive hearings despite committing that he would depose before the commission.
“He was asked by the judicial commission to appear on January 9, 16 and 24 to record his evidence in the memo case. But he did not appear. So I have requested the court that it would be better to save time and the evidence of Ijaz should be closed as proviso of Article 46 of the constitution under which, if primary evidence is delayed or is expensive, the court may record the secondary evidence,” said Zafarullah while talking to Pakistan Today.
He said in this case, the court may record the statement of the ISI DG who had visited Ijaz and seen the evidence.
“So in order to proceed further, the court may record General Pasha’s statement as evidence,” he added.
On the other hand, the counsel for Mansoor Ijaz, Akram Shaikh, also filed a petition with the court that an order be passed to the memo commission to record the statement of Ijaz somewhere abroad due to security threats to his client.
Shaikh also contended that situation reflected that the army, government and the US administration had reached a settlement on the memo issue, but the court should settle the controversy.
Kiani is too busy protecting his position as army chief instead of protecting the borders of the country for which he took the oath of office anf for which he is paid an enormous amount of money. I say we should hang him also for betraying the trust of the nation. As a matter of fact, I think I will put him on trial as soon as I become the king of Pakistan.
My suggestion (free of cost to you) is: first hire your suo mottoing CJ before moving into anything else.
Both of them acted like traitors.
I think I will do away with the justice dept. altogether. No room for judiciary in a kingdom anyway. I may appoint a mouthpiece to tell the nation that whatever decisions I take are the right ones under the constitution (which ofcourse I will write as I move along). Anon, you seems pretty well versed on how things work there. Will you accept a job with me. Ofcourse I will have the entire national gdp at my disposal so money would not be a problem. Shahid, you need to tell us something we don't know.
We should not have paid any attention to Mansoor Ijaz in the first place. The fact of the matter is that everybody was playing politics at national expense.
Are you saying that this accusation (of treason) should not be investigated? I hope not otherwise I will lose any respect for your intelligence. Why is the govt. trying their best to keep him from coming to Pakistan if they have nothing to hide? Why not let him come and make a fool of himself if hr has no proof of anything?
I agree with Kamran about his views regarding 'sipaah salaar e azam' of Pakistan. Unfortunately such is the menatality of all top generals that they consider themselves above the law and for that matter the gullible public get carried away about the myth of invincibility of the armed forces although the track record shows their poor performance on many occasions.
As regards to the theme of the article is concerned, I can assure you that the so called Lord Justices will never ever dismiss the case and will continue to cling on to this 'memogate' and I suspect they may even go abroad to record statement of Mansoor Ijaz. These Justices have already reached to the verdict to hammer nail in the coffin of ailing civilian government.
If our army chief and chief of I.S.I. have examined the evidence, I think Mansoor Ijaz must get once chance to prove what he is saying. His doubts about security arrangements are true because look at PPP. They have not been able to get hold of culprits who killed Benazir Bhutto.
If Mansoor Ijaz gets killed on Pakistani soil, the only sufferers will be his wife and kids. I think our supreme court should order recording his statement abroad because Hussain Haqqani has already proved his guilt by saying that he forgot his Black Berry in U.S.A.
Why is he in Pakistan then? To enjoy "Phajjay ka Payas of Lahore"?, "Palla Fish of Hyderabad"? or "Sabri's Nihari of Karachi"?
