SC wants assurance COAS, ISI DG won’t be sacked

The Supreme Court on Friday directed the government to present within two weeks its stance in writing that it had no intention to sack Chief of Army Staff (COAS) General Ashfaq Parvez Kayani and Inter-Services Intelligence (ISI) Director General (DG) Lt General Ahmad Shuja Pasha.
A three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Khilji Arif Hussain and Justice Tariq Parvez gave the orders after Attorney General Maulvi Anwarul Haq, who appeared on notice, told the court that the government had no intention to remove the COAS and ISI DG and they would serve their tenure. He said the petition against any possible move to sack the military and intelligence leadership was based on assumptions and hypothesis. The chief justice observed that the situation should move towards improvement.
“It would be better if the government submits its stance in writing,” the chief justice said, and directed the attorney general to take formal instructions from the government and submit to the court the reply in writing over the issue within a fortnight. “We want to resolve the issues and it would be better in the interest of the country as well as the nation,” the chief justice said. The petition seeking to block any attempts by the government to sack the military and intelligence leadership was filed by lawyer FK Butt a few weeks ago when the brewing tussle between the civilian government and the military leadership over the memo controversy had already led to the sacking of the defence secretary and triggered speculations that the government might take similar action against the army and intelligence chiefs.

    • The simple answer his GOD. Left to the PPP nd parliament there would be no country to run while the SC for all its good intentions is powerless

  5. Now SC is becoming the epitome of joke in Pakistan's constitutional authority. Zardari should put his foot down. The government should not be hamstrung in its action unless a gross misconduct is proven.

  6. Hiring & firing Army Chief and DG, ISI is patent domain of Executive. If we expect Executive to perform, then we need to accept their authority in their constitutional domain. After that we should leave it to the electorate to decide in next elections. Here Chaudhry wants to be not only Chief Justice but also Chief Executive. This is extremely wrong. Chaudhry welcomes any frivolous petition against government whereas he should be heavily penalising such habitual petitioners.
    By the way, now, he is all set to exonerate Nawaz Sharif in Asghar Khan petition despite irrefutable documentary evidence.

  8. What is this? Ridiculous. Isn't it. Where on the earth a CJ of the apex court would interfere in the working of the government like this.

    So called Sipah Salar is not a sacred cow and unfortunately the supreme court is setting a dangerous example in the history of the country. It was the same military who humiliated the CJP and sent him packing home. It is difficult to ascertain what is the motive behind the action of the CJP.

    The Memogate traitors are on thin ice and should stop plotting against the motherland immediately.

  10. Did the nation struggled for this kind of free judiciary. CJ forgot that poors of the nation are crying for justice and he is wasting his time in playing politics. Perhaps free judiciary means that CJ is free to interfere in the domain of civilians as and when he likes through his favourite petioners. May Allah help our nation.

  11. For God sake Mr Chief Justice give a break to your nation for a while. The PPP government is a weakling and you have been repeatedly hammering it for one or the other reason, This is leading to no where. The government has to exercise its authority if has to? You are very prompt in taking action against this government but have you ever taken an action against those who have committed treason and those who have been involved in target killings. Why don't you form a bench and try Musharraf and why you are hesitating against an ethnic and terrorist party in Karachi who humiliated you on 12th May 2007 and in your recent sham hearing in Karachi you fell short of expectation of the majority of people who were waiting for a concrete action against the murder and miserably failed to name and shame them.
