Lahore High Court (LHC) Chief justice on Tuesday allowed a lawyer to amend his petition, seeking abolition of un-Islamic laws and implementation of laws of Shariah in the country in the light of Objective Resolution.
CJ Azmat Saeed was hearing a petition filed by Ghazi Illumuddin Advocate, calling in question the un-Islamic element in the constitution that gives impunity to prime Minister and president of Pakistan. The petitioner sought a court order to abolish all un-Islamic laws that contradicted with the Objective Resolution of 1949 which provided that un-Islamic laws will be repealed and in their place Islamic laws and Quran and Sunnah will be implemented through a presidential ordinance.
Hinting at the un-Islamic elements in laws of the country, the petitioner said under Article 248 of the Constitution, the president, prime minister, chief ministers and ministers had immunity against criminal proceedings, “while Islam says all people are equal before law and no one has impunity against any crime.”
During the hearing the petition CJ Saeed observed that courts were working according to constitution and law of the land and if any of the laws appeared to be against spirit of Islam, there was a platform of Federal Shariah Court that may be approached against it. Seeing the mood of the court the petitioner sought permission to make certain amendment his petition. The chief justice granted the permission and adjourning further hearing in the matter indefinitely.
GM Railways summoned: The Lahore High Court on Tuesday summoned the general manager (GM) operations and deputy directory Railways Lahore on January 20 for defying the court orders continuously.
The petitioner Allauddin submitted that Federal Services Tribunal had turned down his termination orders from the job issued by department officials on the basis of a false inquiry and directed to restore his job. But, the Railway authorities were not restoring his job despite the orders of FST. He requested the court to issue directions to railway officials for reinstatement his job. The court had sought so many time reports from Railway officials but they did not file any reply and report on the petition.
LHC detains AC, tehsildar over attitude: The Lahore High Court on Tuesday took Shalimar Town assistant commissioner and tehsildar into custody for five hours for not obeying the court orders and later let them go while accepting their apology and assurance to comply the orders.
A citizen Ahmad Gillani filed a contempt of court petition against Assistant Commissioner Shahid Hussain and Tehsildar Imran Safdar. The petitioner submitted that the court had ordered them to retrieve his 54-kanal property in Tajpura from illegal occupants. But the officials defied the orders and had not retrieved his land till now. He prayed the court to take action against then under charges of contempt of court.
The judge summoned the assistant commissioner and tehsildar to explain why they did not obey the court order, but the two officials could not give satisfying answer. Justice Farrukh Irfan Khan, while expressing his annoyance over their attitude, passed the orders to keep them in custody till the end of the court hours. The officials continued to sit in courtroom for at five to six hours like prisoners. However, afterwards the court allowed them to go after they apologised their act and a law officer of the Punjab government undertook before the court that government officials will comply with the orders in letters and spirit.
The court ordered them to come up with compliance of its orders on Jan 23 and submit a report on the issue.
Seven judges transferred: The Lahore High Court (LHC) issued transfer and posting orders of seven judicial officers including a senior civil judge, two civil judges and four civil judges-cum-judicial magistrates.
According to a notification issued by the LHC registrar office, Senior Civil Judge Sahiwal Nadeem Tahir Syed had been posted as Additional District and Sessions Judge Chunian on promotion, whereas Civil Judge Class-1 Shakargarh Muhammad Nadeem had been posted as Senior Civil Judge Sahiwal, on promotion. Civil Judge Class-1 Mudassar Farid Khokhar was transferred from Sahiwal to Haroonabad. The civil judges-cum-judicial magistrates who were transferred include Muhammad Amir Munir from Jhelum to Sheikhupura, Nadeem Ahmad Sohail from Haroonabad to Sheikhupura, Nadir Hussain Shah from Muzaffargarh to Sheikhupura and Muhammad Khan from Rawalipindi to Sheikhupura.
LHC moved on Kargil adventure: The Lahore High Court (LHC) was moved Tuesday for constitution of a commission to probe into the Kargil incident. Rana Illumuddin, the counsel for the petitioner, took the plea in the petition that 13 years had elapsed after the Kargil incident, but facts had not been made public so far. He pleaded that Pervez Musharraf was holding Mian Nawaz Sharif responsible for the incident. He prayed the court to constitute a judicial commission to probe into the incident so that the people could come to know about the factual situation and responsibility could be fixed.
