A nine member Supreme Court bench, led by Chief Justice Iftikhar Muhammad Chaudhry, will on Wednesday pick some other name as the head of the commission to probe into the memo scandal after earlier nominee Tariq Khosa refused to take the responsibility.
According to a senior official of the Supreme Court, the judges would take the decision in chambers, as Khosa’s nomination was a unanimous decision, thus the all nine judges would choose a new name in their chambers. It is being claimed by various quarters that former inspector general of police (IGP) Rafiq Haider could be named the new head of the commission to probe into the “memogate” issue.
In its December 1 order in the case, the SC had held that in case Khosa declined to act as the commission head, he may inform the Supreme Court registrar who would place the matter in chambers for the passing of an appropriate order for taking up the matter either in court or holding proceedings in the chambers. While naming Khosa, the bench had left it to him whether or not to accept the responsibility of probing the case.
After the government raised objections over the name of Khosa, he declined to accept the responsibility and conveyed his refusal to Supreme Court Registrar Dr Faqir Hussain on Friday.
It is very important for Supreme Court of Pakistan to probe this matter and take it to its logical conclusion.
It has become second nature to politicians and public servants in Pakistan to defy law in every day practice. They have considered themselves above law for a very long time.
It is time that it should come to an end.
Supreme Court has lost all its morality by not acting impartially.
So called selective justice is called revenge & not justice>
I think Chief election Commissioner should now take Suo Moto & enroll Supreme Court as a political party.
Do you think SC should toe the line of Govt as were doing in the past. What is partiality in it. It is just to hold probe in to a very serious issue. What is wrong in it.
All our Khuafa, Hazrat Umer, Hazrat Ali respected QAZI and obeyed their order. You want to make SC is section of Govt. They had not given any decision in Memogate nor held any body responsible.
Do u want to see SC as dumb servant of PMLN? Why did it put Hussain Haqani on ECL without notifying him for defence. Even he s not yet accused.
It is manifestly a farcical situation. A lot of credence is being placed by PML N and the Supreme Court on an essentially unreliable person like Mansoor Ijaz who is being regularly refuted and downplayed even by US Govt. The issue is so much technology based that investigations to determine the truth irrefutably may continue indefinitely or may even defy truth altogether. There is a great danger that it may expose the Court to a farcical and compromising situation. We need to be very careful while we still have the time.
This matter does not fall in the domain of Supreme Court though it may well fall in the domain of Chaudhry Court.
