The Islamabad High Court (IHC) issued Tuesday notices to CDA chairman Imtiaz Inayat Elahi, MNA Engineer Muhammad Tariq Khattack and others for defying court orders. The petitioners moved the court, after the respondents had failed to conduct a land demarcation at Behka Sayyedan Wala shrine and adjoining cemetery and remove encroachments from there as per the Lahore High Court orders.
Justice Riaz Ahmed Khan, while hearing a petition filed by Syed Asad Ali, Syed Ibtida Hussain and Syed Arif Hussain through their counsel Muhammad Waqas Malik. The petitioners are the residents of Bhaika Syeddan and devotees of Syed Muzamal Hussain Kazmi whose shrine has been there in Bhaika Syedan for more than 500 years. They submitted to the court that the respondents including CDA Chairman Imtiaz Iniyat Elahi, MNA Engineer Muhammad Tariq, TV anchorperson Javed Chaudhry, Zahid Hussain Anjuman of Darbar-e-Aliya Baba Muzamal Hussain Shah, ICT Assistant Director (I&L) Iqbal Yousaf, Planning Division DG Sarwar Sandhu and Director (Enforcement) Muhammad Ramzan Joiyya were not complying with the orders of Lahore High Court (LHC), Rawalpindi Bench to conduct demarcation of the land and to remove encroachments from the said shrine and graveyard.
The counsel for the petitioner contended that due to the intervention of the respondents in the area of shrine and cemetery, the petitioners wanted that their grievances be redressed. The lawyer said that due to the negligence of the public officials, Javed Chaudhry, operator of the Anjuman Darbar-e-Alia Zahid Hussain and MNA Tariq Khattak were playing havoc with cemetery in question.
He alleged the journalist and anchorperson, Javed Chaudhry, was building a property by razing graves and that he was doing it in connivance with the high-ups of the departments concerned. He also alleged that the Islamabad chief commissioner, after a report was submitted to him by ICT Assistant Director Iqbal Yousaf about the ongoing illegal construction, had also tired to stop the wrongdoing, but to no avail.
The lawyer said Zahid Hussain, in connivance with MNA Tariq Khattak, was trying to grab the land meant for the shrine and the cemetery through misrepresentation. The petitioners requested the court to ensure implementation on the verdict of the LHC Rawlpindi Bench. Upon this, Justice Riaz Ahmad Khan put the respondents on notice and sought their reply in this regard. Separately, the IHC issued notices on Tuesday to federal health sectary and a district health officer while hearing a contempt of court petition filed against them.
Justice Riaz Ahmad Kahn put Federal Health Sectary Muhammad Siddique Akbar and DHO Muhammad Azhar Khan on notice after the judge learned that they had violated the orders of the same court by not appointing the petitioner, Raja Zameer Akhta, against one of the vacancies of the EPI inspectors.
