India releases 12 Pakistanis

Indian authorities on Tuesday handed over 12 Pakistani prisoners, who had completed their sentences, to Pakistani officials at the Wagha Border.
Among these prisoners were three fishermen, while one of the prisoners was mentally unstable. Prisoner Raju was reportedly denied clearance by Indian officials at the last moment and not allowed to enter Pakistan.

  1. Although my son namely, Sikandar-e-Azam Sani s/o Muhammad Khalid Butt has completed his jail term on 30th June, 2011yet his release/repatriation is not being considered by the Indian government. His nationality status being a citizen of Pakistan by birth has already been verified by the Ministry of Interior, Government of Pakistan. Attention of the Honorable Chief Justice of the Supreme Court of India, Acting Chief Justice of the High Court of Jammu & Kashmir, Ministry of Indian External Affairs, Minister of Home, Govt. of India, Mr. Kuldeep Nayyer, Prof. Bhim Singh, and Ms. Hina Rabbani Khar, Foreign Minister, Senator A.Rehman Malik, Interior Minister, Mr. Insar Burney, Senator Talh Mehmood etc have been drawn to this issue but nothing tangible has been heard from any side.

  2. Names of Pakistani prisoners languishing in different Indian jails may be shown in the web page. My son Sikandar-e-Azam Sani S/O Muhammad Khalid Butt is detained/confined in the Central Jail, Kot Bhalwal. Consular access was provided to him on 20th August, 2010. His nationality status has already been verified/confirmed by the government of Pakistan, Ministry of Interior and communicated to the Pakistani High Commission in New Delhi for further necessary action at their end. Home Department has to issue NOC so that his emergency travel certificate for release/repatriation could be prepared. It is not understood why the matter is being delayed. Ms.Hina Rabbani Khar, Pakistan Foreign Minister, Senator A.Rehman Malik, Interior Minister, Foreign Secretary/Interior Secretary, government of Pakistan are requested kindly to take serious notice of this grave injustice. My son has completed his 3-year jail term on 30th June, 2011 yet he has not so far been released by the government of India. Through letters I have requested the Honorable Chief Justice of the Supreme Court of India, Acting Chief Justice of J&K, , the Minister of External Affairs & Home Minister of the India to look into it. Prof.Bhim Singh, Chairman Panthers Party, Mr. Kuldip Nayyer,Senator Talh Mahmood, Mr. Ansar Burney Advocate, & many other have been requested through e-mails kindly to raise their voice in this regard. But I am sorry to say that no one has responded to it positively.

Honorable President, Prime Minister, Foreign Minister, Interior Minister, Foreign Secretary, Interior Secretary Islamic Republic of Pakistan are requested kindly to talk to their counterparts for the release/repatriation of 14-Pakistani prisoners who have completed their jail term/sentence but they are still languishing in different Indian jails. My son (Sikandar-e-Azam Sani) is presently confined in the central jail, kot Bhalwal, Jammu. He has completed his jail term on 30th June, 2011. Nationality status has already been verified by the Ministry of Interior, Government of Pakistan and conveyed to the Pakistani High Commission in New Delhi.   4. This is really unjust. According to a reporter friend in India who checked out this case, when Sikandar-e-Azam Sani was sentenced, the judge did not deduct the time already spent in detention when sentencing him to three years as is normally the case — but which is not mandatory. Thus his time actually runs till 2013 – unless the family moves the HC to have the time that Sikandar-e-Azam Sani already served as an undertrial ‘adjusted’ against the sentence.

Pakistani High Commission in New Delhi may be requested to prepare repatriation order (emergency travel certificate/document ) as 6-months additional rigorous imprisonment of Sikandar-e-Azam Sani s/o Muhammad khalid Butt would now complete on 20th January, 2012 due to non payment of his fine of Rs.3000/- He is presently confined in the central jail, Kot Bhalwal, Jammu. His nationality status being a Pakistani national/citizen by birth has already been confirmed/verified by the ministry of interior government of Pakistan and forwarded to the Pakistani High Commission in New Delhi.

  7. Despite direction of the apex Supreme Court of India to release all Pakistani prisoners (almost 54-Pakistani prisoners), only 5-Pakistani prisoners have been released on 31st January, 2012. I hope rather believe dead line i.e. one month time given by the apex Supreme Court will be strictly observed by Union government in letter & spirit.
