During the hearing of the missing persons’ case on Monday, Additional Attorney General KK Agha informed a three-member Supreme Court bench that the government had appointed Justice (r) Javed Iqbal as Chairman of the Judicial Commission for recovery of missing persons and the notification would be issued shortly.
He told the bench comprising Justice Mian Shakirullah Jan, Justice Jawwad S Khawaja and Justice Khilji Arif Hussain that the government had also constituted a committee that will compensate the heirs of the missing persons. He said, recently 22 cases of missing persons were forwarded to the committee, of which it had scrutinised six cases whose near and dear ones would be compensated. To a court query, he said the name of Justice Javed was finalized to head the commission for recovery of missing persons after thorough consultation.
During the hearing, Amna Masood Janjua, spouse of missing Masood Janjua and chairperson Defense of Human Rights told the bench that they were ready to pardon those who were involved in abduction of their near and dear ones just to resolve the matter of missing persons. She said, at least the heirs of the missing persons must be informed about the whereabouts of their near and dear ones (missing persons). Justice Jawwad Khawaja however observed that the court would not pardon those people who would be found responsible for abducting the people unlawfully. Earlier, mother of missing Faisal Faraz informed the court that she had not yet been intimated about the whereabouts of her missing son. She said the investigation officers even have not yet recorded her statement. Justice Jawwad S Khawaja regretted that as to what kind of investigation it was, when statement of the witness was not recorded. He expressed dissatisfaction over the progress so far made in the investigation of missing persons’ case. Meanwhile, the court referred 252 cases of missing persons to the judicial commission for recovery of missing persons. The court also directed the government to ensure within one week payments of compensation to the heirs of the missing persons. The court while taking up nine chronic cases of missing persons directed the additional AG to submit before it (SC) details about these cases within one week.
The court ordered the government to inform it whether any problem may occur in the payments of compensation to the heirs of the missing persons. Amna Janjua told the court that she wanted to have a meeting with the ISI director general ISI to give him some suggestions about the cases of missing persons. She requested the court to help her in this regard. The court then asked the additional AG to coordinate in this regard. Agha however told the court that secretary defense had already submitted his statement in this regard. Later, the court adjourned further hearing until October 12 directing the government to ensure payment of compensation to the heirs of the missing persons in one week.
