IHC restrains CDA from paying land claim to MPCHS

A single Islamabad High Court (IHC) bench has granted a stay order in a case filed by three separate petitioners against the Capital Development Authority (CDA) for giving claim to Multi-Professionals’ Cooperative Housing Society (MPCHS) for 54 acres of land in northern strip Islamabad it had allegedly acquired from the petitioners in 1969.
Making the CDA chairman, MPCHS president and the Islamabad deputy commissioner respondents, the petitioners contended that CDA had acquired 54 acres of land at the northern strip sector E-11 from them in 1969 for a nominal price.
While, as per the agreement between them and CDA, the compensation for built up property (BUP) was to be announced later on by CDA. However, CDA entered into a joint venture with MPCHS and other societies leaving the matter of compensation to be paid by the MPCHS and other societies, which they were not paying.
The petitioners submitted before the court that instead of paying the compensation money, the MPCHS was trying to dispossess the petitioners without paying compensation in violation of the acquisition letter, said the decision of the CDA board meeting.
They prayed before the court to the restrain CDA from paying any claim to the MPCHS till the authenticity of claim is decided by court. After hearing arguments, Justice Riaz Ahmed Khan granted stay order.
