IHC orders MI, ISI to file replies today

The Islamabad High Court (IHC) on Monday gave another chance to the Military Intelligence (MI) and Inter Service Intelligence (ISI) directors general and other respondents to submit their replies in the case of missing activists of Hizbut Tehrir. Naveed Mukhtar, in his petition, had accused the ISI and MI of kidnapping his brother, Dr Muhammad Waheed.
During the last hearing, IHC Chief Justice Iqbal Hameedur Rehman issued notices to the DGs of the ISI and the MI and other respondents, directing them to submit their replies on the issue on Monday, but they failed to do so.
As Justice Raiz Ahmed Khan on Monday resumed hearing of the case, Deputy Attorney General Raja Abid told the court that in Dr Waheed’s case, replies from the respondents were yet to be submitted. He, however, said that in four similar cases security agencies had denied abduction of the Hizbut Tahrir activists. Justice Raiz Ahmed said if Dr Waheed was not in the respondents’ custody, they should submit counter affidavits so that the court could declare him a missing person.
Umar Hayat Sindhu, counsel for the petitioner, contended that intelligence agencies’ officials had abducted the petitioner and his brother Muhammad Waheed from Rahimyar Khan on August 9. The security agencies had released the petitioner, but his brother was still in their custody, he added.
The court, giving another chance to the respondents, directed them to submit their replies on Tuesday (today).
