Apropos letter by Tariq Malik published in your paper dated July 31. The issue is not the powers of PM, as the spin doctors would like us to believe, but at stake is the issue of obstruction to justice and mandatory constitutional obligation of executive to ensure that all decisions of the judiciary are complied with. Unfortunately, the state and its agencies have failed to apprehend and investigate those who robbed Hajis and created hardships for them in performance of their religious obligation.
When the executive has failed to protect the people and the state exchequer from being plundered, as it has been done in NICL, Steel Mills, missing containers scam, NHA scam, LPG scam, PSO, FBR Fudging scam, Railways, PIA, Rental Powers, DHA Islamabad scam etc, then intervention through suo moto is the rightful role of judiciary to protect the public interest, otherwise there will be chaos and anarchy.
Posting orders during the a judicial probe is tantamount to obstructing investigations underway and therefore is a malafide abuse of power to obstruct justice. By resorting to such unethical practices, the elected executive is perceived as protecting criminals, accused of conspiring to rob the state, or its people and as such is guilty of violating their constitutional oath to uphold the rule of law and discharging their duties as custodians of the state.
Nobody including the judiciary questions the powers of PM to post civil servants on merit for good governance, nor is that an issue. The issue is that the elected executive must not be seen to obstruct judicial process, or place impediments in compliance of judicial orders.
