Take case to sessions court, LHC tells Dost’s wife’s advocate

The Lahore High Court on Thursday dismissed a petition seeking recovery of Ms Zeba Khan Alias Sapna Khan, wife of Sardar Dost Muhammad Khosa, who is allegedly in illegal custody of her husband. The petition was filed by Mohammad Azhar Siddique Advocate in public interest under Article 199 for protections of basic human rights of liberty and free movement.
Justice Azmat Saeed while hearing the petition held that the petitioner was not the directly aggravated party and first platform for remedy in such cases was the court of district and session judge (D&SJ) and the petitioner should move the court of the session judge. The petitioner the same day (Thursday) filed a petition in the court session judge who placed it before additional district and session judge Malik Mobeen for hearing.
Malik Mobeen after hearing argument by Azhar Siddique sought report till from CCPO and SHO Racecourse by July 16. Counsel Azhar Siddique Advocate said Ms Sapna Khan was allegedly in illegal custody according to a news report. He said her daughter was also snatched from her by the some unknown persons, as reported in the news item and lack of rebuttals or clarification proved the authenticity of the news report.
Mr Siddique submitted that the police was reluctant to take any action because the main accused was Punjab ex-chief minister Sardar Dost Muhammad Khosa. Whether there exists any family dispute or not, the life and liberty of every citizen has to be protected, hence this court is requested for appropriate orders of production of Ms Zeba Khan in public interest and for protecting the fundamental rights constitutionally guaranteed to her, he said, adding that after the safe production, the policemen and the accused should also be brought to justice.
