The Sindh High Court on Monday directed the Sindh Home Secretary, the Sindh Inspector General of Police and other respondents to file their comments on affidavit along with complete record of cases of Mohajir Qaumi Movement-Haqiqi Chairman Afaq by July 14.
The High Court issued these orders on a constitutional petition filed on behalf of Ahmed against his possible arrest after his release from jail and record of cases that were registered against him during his detention.
Ahmed filed the petition through his counsels Ilyas Khan and Khurram Masood, submitting that several counterfeit and baseless cases were registered against him, but none of the charges have been proven during the trial.
The counsels argued that whenever Ahmed is acquitted from a charge, new cases are registered against him by the police to keep their client in prison.
They suspected that their client might be booked again in a new case and would not be allowed to leave the prison, despite the fact that his bail plea was granted by the court in the previous case. After hearing the arguments from the petitioner’s side, the court issued notices to the respondents and directed them to submit their comments until July 14.
The petitioner submitted that the court had set aside a lower court’s order regarding life imprisonment and granted his bail plea. Another criminal revision regarding a murder case filed on behalf of Ahmed would be proceeded on Tuesday at the High Court. Ahmed’s counsels filed a criminal revision against the involvement of their client in a murder case in the Nabi Bux police precincts.
Complainant Shahzad Ahmed had registered a First Information Report, stating that he was on his way home in 2009 with his friend Junaid when accused Asim and Talat opened fire on them.
Junaid and Shahzad were wounded and a passer-by Atiq Rehman was killed on the spot. According to the complainant, the accused had attacked them on Ahmed’s orders.
Ahmed’s counsels argued that this case is politically motivated and their client was being detained in the Karachi Central Jail at the time of the incident.
