The Supreme Court on Wednesday referred an election dispute of NA-41 South Waziristan to the Election Commission of Pakistan (ECP) when it was informed that the ECP had been constituted under the provisions of the 18th Constitutional Amendment. A three-member Supreme Court bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Parvez and Justice Amir Hani Muslim was hearing an election petition challenging the election of Jamiat-e-Ulema-e-Islam (JUI-F) MNA Maulana Abdul Malik from NA-41, South Waziristan. The court directed the ECP to decide the matter within three weeks. At the outset of the hearing, Maulana Abdul Malik’s lawyer told the court that the ECP had been constituted under the provisions of the 18th Constitutional Amendment.
