LJCP seeks proposals to curb crime against women

The Law and Justice Commission of Pakistan (LJCP) on Saturday took serious note of the practice of giving women and young girls in marriage in exchange for reconciliation (Badal-e-sulha) on the intervention of jirga and panchayats, and suggested stringent action against those involved in the practice.
The commission asked the LJCP Secretariat to suggest amendments to relevant laws so that action could be taken against all those involved in such crimes against women. While presiding over an LJCP meeting on Saturday, Chief Justice Iftikhar Muhammad Chaudhry said the constitution safeguarded the fundamental rights of the citizens and it was binding on all state institutions to adhere to the provisions of the constitution while discharging their functions.
“The system of administration of justice revolves around the provisions of constitution which provide safeguards for fundamental rights of the citizens; therefore, it is incumbent upon all the institutions to adhere the provisions of constitution in discharging their functions,” he said. The CJP said there was a need for drafting new laws on issues related to public importance and bringing existing laws in accordance with changing needs of the society.
He also stressed on the need for simplifying laws for easy comprehension and removing inconsistencies within laws and the legal system. He said that legislation should be made after observing the due process as provided in the constitution. The commission approved accounts and expenditure of the Access to Justice Development Fund.
It also examined proposals for law reforms for amendments in the Law and Justice Commission of Pakistan Ordinance, 1979 and recommended amendments for including the chief justice of the Islamabad High Court as a member of the commission, empowering the LJCP to sign MOUs with the foreign law commissions for conducting research and insertion of provision to allocate funds for the provincial judicial academies from the Access to Justice Development Fund.
The commission also recommended amendments be made in the National Judicial (Policy Making) Committee Ordinance, 2002, for including the chief justice of the Islamabad High Court as a member. The commission also approved the rules for regulating the functions of District Legal Empowerment Committees constituted under the Access to Justice Development Fund (AJDF) for providing legal aid to deserving litigants who were unable to obtain legal aid or assistance for protecting their genuine legal rights or interests on account of limited financial resources.
The commission also examined the proposal for Repeal of Federal Court Act, 1937 and after deliberations recommended that the enactment, being redundant, may be repealed. The meeting was attended by Federal Shariat Court Chief Justice Agha Rafiq Ahmed Khan, Balochistan High Court Chief Justice Justice Qazi Faez Isa, Peshawar High Court Chief Justice Ejaz Afzal Khan, Lahore High Court Chief Justice Ijaz Ahmad Chaudhry, Sindh High Court Chief Justice Mushir Alam, Attorney General for Pakistan Maulvi Anwarul Haq, Ministry of Law Secretary Masood Chishti, Federal Public Service Commission Chairman Justice (r) Rana Bhagwandas, former BHC chief justice (r) Amirul Mulk Mengal, National Commission on the Status of Women chairperson Anis Haroon, advocate Supreme Court Qazi Muhammad Jamil and Law and Justice Commission of Pakistan Secretary Habibur Rehman Shaikh. Islamabad High Court Chief Justice Iqbal Hameedur Rehman attended the meeting on special invitation.

  1. i have experience of 4 years as public prosecutor it was observed during the secrutnising of polic reports us 173 CR P C from diferent polic stations of Gujranwala victomised women and women coplainent face very problems during investigation specially in abduction cases sexuel [harasment and assualt] cases and other domestic voilence accused persons mostly stand inocent [in column no 2] there is no avidence collected by i o in favour of women.in gambling cases mostly husband lose his wife as his property this problem is not mentioned in any case against gambler there should be asstablished a women protection in every distric in shelter of ljcp with mangement of ex public prosecutor regards:Library secartary D.B.A Gujranwala reena mumtaz sarwar
