SC returns petition on Abbottabad

The Supreme Court on Thursday returned a petition seeking the trial of the president, prime minister and others under Article 6 for violating the constitution and committing criminal negligence in the Abbottabad operation on May 2.
The Supreme Court registrar’s office returned the petition for not being maintainable on grounds that the petitioner had no locus standi to file the petition.
The president and prime minister of Pakistan could not be named respondents as they enjoyed immunity under Article 248 of the constitution, the registrar’s note said.
The registrar’s office noted that the petitioner had not provided certificate as required under Order XXV Rule 6 of the Supreme Rules, 1980. The office advised the petitioner to approach the proper forum for the removal of his grievance.
Chaudhry Muhammad Bashir had filed the petition through his lawyer Muhammad Ikram Chaudhry under Article 184(3), praying the prime minister, president, chief of the army staff, chief of air staff, Inter-Services Intelligence (ISI) director general and others be tried under Article 6 for violating the constitution, conspiracy and criminal negligence against the sovereignty as well as life and liberty of the citizens of the country.
The petitioner also named the Law secretary, Khyber Pakhtunkhwa chief secretary, Khyber Pakhtunkhwa inspector general of police and the Intelligence Bureau Islamabad IG as respondents.
The petitioner requested the court to pass an order for an impartial inquiry by a judicial commission against all the respondents and deal with those found responsible accordingly.
Later, Muhammad Ikram Chaudhry said he would file an appeal on behalf of his client against the registrar’s objections.
