Any criminal act that is done by an individual and is contrary to policy of law will be considered illegal. Suppose, an agreement is made between two parties; one in Afghanistan and the other in Netherlands to smuggle 500 kg of Afghan opium by filling it in biscuits. This agreement is illegal and both parties will be punished if the airport security catches the drugs hidden in biscuits.
Surprisingly; despite the huge increase in such statutory offences, there is little authority on this point. Cases that involve this point are treated either as cases of illegal performance or of statutory illegality. Courts will always consider policy of law while making decisions about any agreement. It will be impossible to consider that the court will hold a contract of committing crime illegal without taking policy of law into consideration.
Therefore, all agreements done to commit criminal acts are illegal because they are contrary to policy of law and must be punished according to court of law.
