Afaq, Amir appeals should be heard by Shariat Court, says govt… Nothing doing, replies SHC

The Sindh High Court (SHC) on Monday rejected the Sindh government’s plea to transfer hearing of the appeals of Mohajir Qaumi Movement-Haqiqi (MQM-H) leaders Afaq Ahmed and Amir Khan to the Federal Shariat Court (FSC). Sources in the Sindh Law Department told Pakistan Today that the Sindh government had filed the appeal due to pressuring of coalition partner Muttahida Qaumi Movement (MQM).
When the case was brought for hearing on Monday before the court of Justice Ghulam Sarwar Korai, the Sindh government pled that the case’s jurisdiction fell under the FSC. Korai refused the argument, however, and postponed proceedings till May 2. Ahmed and Khan were awarded life imprisonment last year by the court of District and Sessions Judge Ubaid Ahmad Khan in a case pertaining to the murder of a Muttahida Qaumi Movement (MQM) activist named Farooq.
The prosecution had alleged that four Muttahida workers were kidnapped at their behest; three were subjected to severe torture and were later set free, but Farooq was killed. Following their conviction, both leaders had filed appeals through their lawyers against the verdict. KARACHI:Kaleem Ahmed, a man in his mid-20s, confessed to raping and killing a 14-year-old girl on Monday in the court of judicial magistrate-South.  
Ahmed had been arrested on April 21 for his involvement in the murder of a teenage girl when she resisted his attempt to rape her. After initial investigations, the suspect had suggested that he strangled the 14-year-old girl near Jubilee Market and dumped her body in the Garden area. In his confession statement before the court, Ahmed said that he had persuaded the girl to visit his shop’s warehouse situated in the same area.
There he tried to carry out his plan but the girl resisted and in order to stop the girl from screaming he covered her face with a plastic bag and put his hands on her mouth that led to her suffocation and claimed her life. According to the investigation officer of the case, the suspect stuffed the body in a bag and dumped it in a deserted area. He said that at first, the suspect claimed that he had not raped the girl but had killed her “in fear.” The suspect was initially booked under Section 302 (premeditated murder) of the Pakistan Penal Code in an FIR 12/2011.
