Non-bailable arrest warrants issued for two doctors in Imanae case

Model Town Judicial Magistrate Sahir Islam on Monday issued non-bailable arrest warrants of two doctors of Doctors Hospital allegedly involved in the death of minor Imanae Malik. The magistrate issued the order when the counsel for Imanae’s father submitted that despite lapse of considerable time, police failed to arrest two nominated accused Dr Ghazanfar Ali Shah and Dr Javed Asghar, who also did not appear in court on their own.
The counsel requested the court to issue arrest warrants of the accused and direct police to produce them in court. Islam directed police to present the accused in court on May 13.The magistrate is holding trial of the case registered with the Johar Town Police on November 28 2010. Earlier on May 19, 2010, charges had been framed against Dr Sanaullah, Ziaul Hassan Bokhari and Fahmida Sanaullah. The magistrate had also turned down applications of the accused for exemption from personal appearance in court and the Lahore district and session judge also dismissed the revision petition against the order with the direction that for framing of charges, personal appearance of the accused was necessary.
Advocate Azhar Siddique argued that the accused are intentionally not appearing in court and without informing the court had left the country. A private complaint (Istaghasa) for trying the accused under sections 302/34, 109, 201 and 420 of the Pakistan Penal Code (PPC) is also pending before an additional district and sessions judge while the inquiry proceedings are fixed for April 30, 2011. Three-year-old Imanae Malik had suffered minor burns on her hands and was taken to Doctors’ Hospital where doctors administered three injections of high potency anesthesia to her which resulted in her death. Former Lahore High Court (LHC) chief justice (CJ) Khawaja Sharif had also taken suo motu notice of the incident.
