Expressing deep disappointment over the Supreme Court’s judgment in Mukhtaran Mai gang-rape case, her counsel, Ch Aitzaz Ahsan, has announced to challenge it through a review petition.
In a press release issued on Saturday, former president of Supreme Court Bar Association (SCBA) said he was deeply disappointed at Supreme Court’s verdict of acquitting all but one accused. The judgment was manifestly flawed and not based on the evidence available on the record.
“In drawing their conclusions, the learned majority judges have disregarded cogent evidence and failed to notice actual material on the record and the facts proved thereby.”
Aitzaz said the judges also misread evidence that they had adverted to and failed to take notice of the social backdrop, which was established on the record itself, and in the context of which the horrendous crime of gang-rape was committed, reported and investigated.
Aitzaz said the decision needed to be reviewed and recalled. “I have consulted with Mukhtaran Mai, and we have decided that a petition seeking review of the April 21 judgment will be filed soon,” he opined.
He said the petition would contain a full critique of the judgment and there was no need to make any other comments in the media on the subject.
