ISLAMABAD – A three-member Supreme Court bench headed by Chief Justice Iftikhar Muhammad Chaudhry on Tuesday issued notices to the Speaker National Assembly and Attorney General on a petition challenging the constitutional validity of the Election Commission of Pakistan (ECP) under the 18th Amendment. The petition was filed by Barrister Syed Ali Zafar on behalf of a TV Anchor Mubasher Lucman stating that the matter involved issues of great public importance.
Barrister Ali Zafar argued that the 18th Amendment had reformed the composition of the Election Commission of Pakistan, which was yet to be constituted. He relied on Article 218 of the Constitution, as amended by the 18th Amendment, which provided for the composition of the Commission consisting of the Chief Election Commissioner as chairman and four members hailing from the four provinces to be appointed by the president.
