SC moved against illegal allotment of plots to former CJP, others

ISLAMABAD – The Supreme Court was requested on Monday to take suo motu notice of the illegal gratification in allotment of residential plots to the then chief justice of Pakistan Sheikh Riaz Ahmed and others by National Police Foundation (NPF), Islamabad in their Housing Scheme in E-11 Sector of the federal capital.
The application for suo motu notice was filed by Dr Muhammad Aslam Khaki, an Islamic jurist and Supreme Court advocate, under article 184 (3) of the constitution, praying the Chief Justice of Pakistan Iftikhar Muhammad Chaudhry to take suo motu notice into the matter and to get the people involved punished.
He alleged that the then chief justice of Pakistan Justice (r) Sheikh Riaz Ahmed, Ms Nusrat Rauf, wife of the then CDA chief and now Secretary Establishment Division Abdur Rauf Chaudhry, Major Nadeem Rafique, Aftab Iqbal Chohan, Awais Akhtar and Major (r) Mushtaq Ahmed used their official position and influenced to get the residential plots of million of rupees on nominal price without their entitlement and totally against the rules and laws.
He said the then CJP Shiekh Riaz Ahmed got two plots in the scheme. “Public is agonized and shocked and it asks the government and the public institutions through the apex court whether the law is only for the forth class poor public servants,” Khaki said. He said these persons in the name of helping in the development of the scheme indirectly accepted the allegations of bribe or illegal gratification.
Dr Khaki further stated that some of them to whom the plots were allotted were in fact middle men and had no entitlements in the NPF housing scheme, adding that hundred of other plots meant for the Shuhada (martyred) of police department were allotted to totally un-entitled persons as bribe. He said Mrs Nusrat Rauf had been very helpful to NPF by removing various hurdles of the scheme while Major Nadeem Rafique, being an army officer had been helpful towards the housing projects of NPF.
Similarly, he stated that Aftab Iqbal Chohan used his influence at high level for early maturity of the project while Awais Akhtar managed the land possession from local affectees for creation of plots and had been very helpful in solving problems with affectees at the site. He said there are hundred of cases in which public parks, public amenity plots and green areas have been converted unlawfully to residential and commercial plots to benefit themselves and other influential people in connivance with CDA and property dealers.
The applicant requested the CJP to summon the record of NPF housing scheme in sector E-11, Islamabad and order its scrutiny, adding that he is ready to provide the clear evidence and record of illegalities. Khaki also attached with his application the provisional allotment letter of one plot of 500 square yards issued by NPF to Justice (r) Sheikh Riaz Ahmed as a very special case.
