LHC seeks trial court record of Raymond case

LAHORE – Lahore High Court judge Justice Ch Iftikhar Hussain on Tuesday sought complete record of trial court which acquitted CIA contractor Raymond Davis in double murder case after the legal heirs of deceased Fizan and Faheem had pardoned him by accepting blood-money (Diyat) from accused.
The court passed this order on a writ petition filed by Advocate Rana Ilamud Din challenging payment of Diyat money as, according to him, trial court left a lot of lacunas and acted in haste while announcing the acquittal of Davis.
He prayed, “Additional Sessions Judge Yousaf Aujla acted in sheer violation of Sharia law as neither identification of all legal heirs was confirmed nor any time was given to them to ascertain the fact if they were making statements under coercion and duress.”
Petitioner also beseeched to the court to initiate proceedings to ascertaining the responsible who avoided inclusion of Anti Terrorism Act and charges of spying in the FIR. He pointed out legal heirs’ signatures were not found on many court papers they were supposed to sign.
He claimed that it was the Law Ministry that paid Diyat money from national exchequer which he said was the violation of the Diyat law.
