ISLAMABAD – The government filed a review petition on Monday against the Supreme Court (SC)’s decision overturning the Parliamentary Committee (PC)’s rejection to grant one-year extensions to six additional judges of the Lahore High Court (LHC) and Sindh High Court (SHC), which were recommended by the Judicial Commission. In the review petition filed through Deputy Attorney General KK Agha, the government contended that an incorrect and flawed assumption was made in the apex court’s verdict that only the Judicial Commission was in the best position to assess candidates for judgeship.
It said that in the United States judges were appointed by the legislature, yet there was an independent judiciary there. The government contended that the apex court had rewritten a part of the constitution (Article 175-A) in its March 21 verdict by going beyond its power of interpreting the constitution under the doctrine of judicial review. It contended that the apex court had erred in ruling that the PC was not part of parliament, stressing that on the contrary, it was the very part of parliament that represented the will of the people.
