LHC asked to stop auction at Park and Ride Plaza

LAHORE – The Lahore High Court has been moved through an application to stay the auction of shops and a restaurant at the first floor of Park and Ride Plaza, (Liberty Parking Plaza) at Liberty Market.
The plea was moved by Mohammad, Ahmed and other shop owners in an already pending petition against the construction of the said plaza, which the petitioners claim, has been built on the land which originally was allocated for the development of a park.
The application under CPC section 151, prays for the staying of the auction of 26 shops on the first floor of the Plaza inter alia contending that it was based on malafide intent to deprive them through coercion and harassment of their due rights in so far as they are not being allowed to let their customers park vehicles in front of their shops, an act which was both illegal and unconstitutional.
They further contend that the court had issued a pre-admission notice to respondents on February 9 2011 and had since been making efforts to realize ulterior motives to auction all shops, restaurant and mini cafe so interests could be shifted to the intended purchasers to create hurdles in the fair decision of the constitutional petition.
They said a reply to the petition has been submitted but copies have not been yet been supplied to the petitioners, which held them back from filing a rejoinder. They further alleged that the respondents previously requested the adjournment of the case till April 15, which applicants objected contending that respondents intended to sell out the plaza in meanwhile, making the new purchasers the stakeholders.
Applicants said the project was a purely commercial project and had been built on an ‘amenity’ plot through a large investment of public money.
