ISLAMABAD – Chief Justice Iftikhar Muhammad Chaudhry on Thursday observed that the non-formation of the Election Commission of Pakistan (ECP) had created many complications in election process. Heading a two-member bench with Justice Ghulam Rabbani, the chief justice said ECP had to be constituted in accordance with the 18th Amendment, therefore election disputes in South Waziristan were filed in the Supreme Court.
Ghalib Khan, a runner up candidate for National Assembly from NA-41 South Waziristan, had challenged the victory of Maulana Abdul Maalik Wazir. The petitioner pleaded that as a result of recounting, he had won the election from NA-41 in two polling stations. But Maulana Maalik had filed a petition in Islamabad High Court (IHC) that passed verdict in favour of Maulana Maalik.
