Appointment of Sindh AG challenged

KARACHI – A petition challenging the appointment of Sindh Advocate General (AG) Abdul Fattah Malak due to overage was filed in the Sindh High Court (SHC) on Saturday.
Petitioner Abdul Salam Memon submitted that the provincial AG is appointed on the criteria that he can become a high court judge under the article 140 of the constitution of Pakistan.
After the resignation of former AG Sindh Yousuf Leghari, 69-year-old Malak was appointed as the Sindh AG, whereas, the retirement age of a high court judge is 62 years, he added.
Citing provincial Law Department secretary and Sindh AG as respondents, the petitioner prayed to the court to direct the government to withdraw the notification regarding Malak’s appointment. It is worth mentioning that two additional advocate generals, Sarwar Khan and Shafi Memon, are also nearing their 70s but still working on the said posts.
Khan was appointed during the tenure of the previous government while Memon was appointed in the present government’s time allegedly on political basis, as he is a taluka president of PPP and also a partner of Senior Education Minister Pir Mazaharul Haq in a legal firm.
