PHC suspends show-cause notice issued by PCO judge

PESHAWAR – The tussle for power and authority among the judicial circles took another twist Friday when a three-member bench of the Peshawar High Court (PHC) suspended the show-cause notice served on four judges of the Supreme Court of Pakistan.
Justice Jehanzaib Rahim of PHC through an order on Thursday had issued the show-cause notice to the PCO judges in a contempt of court notice. Justice Jehanzaib, a PCO judge, had questioned the authority of the SC judges of serving contempt of court notice on him, saying he was not a subordinate of the SC and serving as a judge of Khyber Pakhtunkhwa’s top court.
He also challenged the authority of Chief Justice of Pakistan Iftikhar Muhammad Chaudhry who, according to him, had also administered oath under PCO. However, a three member bench of the PHC comprising Chief Justice Ijaz Afzal Khan, Justice Dost Mohammad and Justice Mazhar Alam through a short order suspended the order.
The court also asked the PHC’s Registry Branch not to entertain Justice Jehanzaib’s order.
