Two more PCO judges file intra-court appeals against contempt orders

ISLAMABAD – Former de-facto chief justice of Pakistan, Abdul Hameed Dogar, and dysfunctional PCO judge of Sindh High Court Yasmin Abbasey on Thursday filed intra-court appeals in the Supreme Court seeking setting aside of its earlier short order of initiating contempt proceedings against them from February 21.
Earlier on February 15, Justice (r) Iftikhar Hussain, former LHC chief justice had filed an intra-court appeal in the Supreme Court seeking setting aside of its earlier short order of initiating contempt proceedings against him. On Monday, Justice Shabbar Raza Rizvi and Justice Hasnat Ahmed Khan, dysfunctional judges of the Lahore High Court, had filed similar intra court appeals with the Supreme Court. Justice Sayed Zahid Hussain, a dysfunctional SC judge, had also filed the appeal recently, which was returned for being contemptuous.
A four-member Supreme Court bench headed by Justice Mahmood Akhtar Shahid Siddiqui on February 2, 2011, announced its verdict on legal point as to whether it could initiate contempt proceedings against the judges who had taken oath under the Provisional Constitution Order (PCO) in defiance of seven-member bench’s restraint order of November 3,2007, and whether it could issue contempt notices to generals involved in promulgation of November 3, 2007, emergency in the country in defiance of the restraint order.
The court had ruled to frame charges on February 21 against nine judges of the superior courts who had taken oath under the PCO. The bench had also ruled that these judges could appear on that date either in-person or through their lawyers to enter their pleas on charges framed against them. The judges against whom the court would frame contempt charge are Justice (r) Iftikhar Hussain Chaudhry, Justice (r) Abdul Hameed Dogar and dysfunctional judges Justice Hamid Ali Shah, Justice Hasnat Ahmed Khan, Justice Syed Shabbar Raza Rizvi, Justice Yasmin Abbasey, Justice Jehan Zaib Rahim, Justice Sayed Zahid Hussain and Justice Syed Sajjad Hussain Shah.
