ISLAMABAD – A lawyer on Monday filed a petition in the Supreme Court of Pakistan against Islamabad High Court’s verdict of dismissing plea for quashing of the FIR and the trial of Salman Taseer’s self-confessed assassin, Malik Mumtaz Hussain Qadri.
The appeal was filed by Zafar Awan advocate. Earlier on Jan 26, a division bench of the IHC had set aside an intra-court appeal filed by Awan seeking cancellation of case against Mumtaz Qadri, the police guard who was part of security detail for the then Punjab governor Salaman Taseer, but who, instead, turned his gun on governor.
The bench comprising IHC Chief Justice Iqbal Hameedur Rehman and Justice Riaz Ahmed Khan had maintained that the appeal was not maintainable for hearing as the appellant, Zafar Awan advocate of Chakwal, was not the “aggrieved party” in the case. The IHC had upheld the Jan 20 verdict on the same plea by its single bench comprising Justice Anwar Khan Kasi.
Justice Kasi had thrown dismissed the petition saying that “no citizen could be allowed or encouraged to take the law into his own hands”.
