In the petition filed through Shahid Bilal Hassan, petitioner submitted that in 2004, Ayub purchased the said property bearing number 1-E/III, Main Boulevard, near the United Christian Hospital (UCH), Gulberg-III Lahore commonly known as Qasr-e-Zauq Wedding Hall Shaheen Khan, Nina Ashfaq Elahi, Athar Akram, Shahida A Ishtiaq, Rubi Razaaq, Amir Akram, Nadir Asghar, Asad Akram, Aurangzeb Akram and Zainab Amanat. Afterwards, Ayub suffered heavy losses in the business on which many investors approached the NAB, which took Ayub into custody. During detention, Malik Qayyum and Iqbal Tikka approached the businessman and offered him help especially in returning money to claimants.
They showed keen interest in purchasing the property from Ayub and obtained his signature and thumb impressions on various blank papers, including stamp papers, on pretext that the signature and thumb impressions would be used for preparing the sale deed. Qayyum and Tikka prepared fake documents in Gulzar’s favour or his nominees and deprived Ayub from his property without paying him a single penny while the senator and his accomplices were earning hundreds of thousands rupees daily by running the marriage hall on Ayub’s property.
After four years of Ayub’s detention, his son moved bail application in the Supreme Court and the apex court directed NAB authorities to arrest the accused who were illegally occupying Qasr-e-Zouk. Ayub requested the court to pass an order to declare the sale deed under which Iqbal Tikka and Qayyum got the property transferred in favour of Asian Gas Private Limited as illegal, malafide, fraudulent and fictitious and they be permanently restrained from selling and dealing with the said properties and from changing its nature and character in any manner whatsoever.
