Sindh High Court orders removal of inept DCOs

KARACHI – The Sindh High Court (SHC) on Tuesday directed the provincial government to dismiss Kambar Shahdadkot District Coordination Officer (DCO) Ghulam Qadir along with all the DCOs in the province without the required qualification.
District Management Group Officer Gul Hassan Channa had filed a constitutional petition under Article No 199 of the Constitution through his counsel, Advocate Abrar Hassan, challenging the direction of the Sindh government on the appointment of Larkana Development Authority (LDA) Director General (DG) Muhammad Yasin Shar as the DCO of Kambar Shahdadkot district.
The petitioner impleaded the Sindh chief secretary and the Kambar Shahdadkot DCO as respondents and stated that the Sindh government had violated its own laws by appointing the LDA DG as the Kambar Shahdadkot DCO.
The petitioner referred to many laws regarding the issue, according to which only those officers could be appoint as a DCO who have successfully completed specialised training in district administration as well as passed from the Civil Services Academy in Lahore or the Provincial Services Academy in Peshawar.
The officer must also have successfully passed the departmental examination of Assistant Collector Part I and II. The petitioner prayed the court to set aside the Sindh government’s notification regarding the appointment of Kambar Shahdadkot DCO along with all the other DCOs posted without required qualification and training.
The SHC division bench, comprising Justice Shahid Anwer Bajwa and Justice Tufail H Ibrahim, allowed the petition and set aside the notification of Shar’s appointment. The bench also directed the government to post only those people as DCOs who hold the required qualification.
