ISLAMABAD: Accepting an application for early hearing, Chief Justice Iftikhar Muhammad Chaudhry has constituted a three-member Supreme Court bench to settle a law point whether the fresh election nomination papers could be accepted after the scrutiny.
The bench comprising Justice Javed Iqbal, Justice Mian Shakirullah Jan and Justice Raja Fayyaz Ahmed will hear the case on Dec 23. The application for early hearing of a pending civil review petition was filed by Chaudhry Muhammad Ilyas Gujjar, an ex- candidate in the NA-123 constituency.
The petitioner had requested the Supreme Court in January this year to review its judgment in the case relating to bye-election in NA- 123 constituency (Lahore-VI), wherein court upheld that the fresh nomination papers could be filed, and issued directives to the Chief Election Commissioner to commence the election process in the constituency from June 1, 2008, leaving no room for acceptance of fresh nomination papers. The petitioner had also sought that the CEC be made to announce date of polling for elections.
Former attorney general’s murder: A three-member Supreme Court bench on Monday rejected a police investigation report and ordered the police chiefs of Islamabad and Khyber-Pakhtunkhwa to appear on the next date of hearing to clarify why the killers of former Attorney General Muhammad Sardar Khan had not been arrested even after 10 months.
The bench comprising Justice Javed Iqbal, Justice Mian Shakirullah Jan and Justice Raja Fayyaz Ahmed was hearing a suo motu action taken against the murder of Muhammad Sardar Khan who was also a retired judge of the Peshawar High Court.
