LAHORE – Defence Housing Authority (DHA) director transfer and DHA secretary ended up being charged with contempt of an accountability court as a result of a clash between the orders passed by two courts over a property transfer.
A case was being heard in the court of additional district and session judge over the transfer of a plot 276-K DHA Phase-1 between Chaudhry Salman Ashraf and Muhammad Ashiq. The court passed an order to transfer the plot in the name of Salman. Ashiq, a nominated accused in an under trial reference in an accountability court, filed an application against the transfer of plot in Salman’s favor.
The accountability court accepted the application and passed an order in favor of the applicant. After this order, Salman moved an application in the court of additional district and session judge for the execution of the order earlier passed by the said court.
The judge on this application observed that his court had passed the order earlier than the order by the accountability court, so the order passed by his court would stand. In compliance of the said order, DHA transferred the plot in the name of Salman.
In response to the action taken by the DHA, Ashiq filed a contempt application against DHA director transfer and DHA secretary in the accountability court. The accountability court issued notices to the accused and fixed January 8 for the framing of charge.
Faisal Hanif and Shamim Durrani, counsels for the accused, submitted that the matter was in NAB authorities’ notice and they did not inform the accountability court; thus the court had to issue notices to DHA director transfer and DHA secretary.
