Carly Simon has lost the latest round in her long-running legal battle with coffee shop giant Starbucks over her album, ‘Never Been Gone’. The veteran singer sued Starbucks bosses last year after they axed a distribution deal with record company ‘Hear Music’ just five days before the label was due to release her new disc.
Simon argued she should have been informed the agreement was being wound down because it would have a huge impact on the marketing and sales of her album. In April, Los Angeles District Court Judge George Wu ruled in Starbucks’ favour after hearing company bosses had no direct deal with Simon and no obligation to inform her that the ‘Hear Music’ arrangement was coming to an end.
The ‘You’re So Vain’ hitmaker was allowed to file an amended complaint – but last Friday Judge Wu again ruled against the singer, agreeing with Starbucks’ lawyers that she had waived her rights to hold them liable for any difficulties with ‘Hear Music’. It is not known if Simon plans to continue her legal fight.
