Foreign magazine castigates CJP as an ‘unelected judge’

Time magazine, a foreign-based magazine, has targeted CJP Iftikhar Muhammad Chaudhry for being ‘a lazy-eyed abrasive, un-charismatic, and visibly uncomfortable for scripted speeches’.
Expressing fears that taking suo motto notice and by keeping ‘his (CJP’s) unending pursuit of President Zardari, might endanger democracy, the media source terms CJP as “an unelected judge”, who has shown no letup in his vendetta against an elected prime minister and President Zardari, even at the cost which the country would end up paying.
This, despite the fact that Pakistan/democracy has nevertheless withstood countless ‘indispensable democratic (and non-democratic) heroes’ in past with aplomb.
The media source does not even spare CJP’s accepted ancestral honesty amid a hornets’ nest infested with blatant corruption and blind power, terming it as the source of CJP’s ‘obdurate and unending Robin Hood attitude’.

  1. It is utter nonsense. When the Supreme Court decides, its decision is final and must be obeyed. It is not a new concept. It symbolises Rule of Law. The problem with the present regime and its allies is that they are small people with small brains and they speak without thinking it through. The Court decided on the arguments put before it. In the “Pir” of Multan’s case, he did not lodge an appeal nor sought a stay. Under these circumstances what other alternative the Court had but to enforce its decisiuon. The caption of the foreign magazine is based on sheer ignorance. Remember this. Had it not been because of the Chief Justice, the Country would have gone to dogs completely. A corruption quagmire of almost biblical proportions unleashed by Mr. 10 % Hazrat Janab Asif Ali Zerdari Sahib (be peace upon him and gift of God to the Islamic Republic of Pakistan) and his hench men would have gone on unchecked but because of the C J. We should feel blessed that we have him and his team at the Supreme Court. .

    • What will we do if SC makes decisions which r absolutely illegal and imply revenge and political activism. Democracy is Parliamentary supremacy. It is parliament which gave birth to govt and judiciary. Democracy is all about supremacy of people expressed through their elected parliament. That s why in advanced countries like USA, Canada, India, and UK etc executive appoints the judges and judges are answerable to parliament. We should not blindly support what suits our political party interests.

  24. 1) Supreme Court is supposed to interpret Constitution. Presently, it is misinterpreting it with impunity. SC cannot be given the power to dismiss elected Prime Ministers.
    2) Perhaps the Constitution did not foresee that we will have judges who will validate military take-overs and when conditions are not right for Army to do the job, they will be more than happy to do it on their behalf as well as that of an impotent opposition.
    3) It is time that Parliament takes appropriate steps to assert its supremacy and curb the present wild judiciary which is behaving like bull in a china shop.
    4) As per Charter of Democracy, all judges who ever took oath under PCO must be dismissed forthwith. Needless to mention that Iftikhar has the signal distinction of taking oath under PCO twice.
    5) Apart from other matters, there are serious corruption allegations against Iftikhar. No investigation is possible without interrogating him, his wife and all his children. After all of them at least had a hell of a good time in Europe at a litigant's expense.
    6) Also, a father who does not know what his done for a living especially when the two share the same roof is unbelievable. Iftikhar said so with Holy Quran in front of him which he voluntarily brought to the court. A man who presides open court and tells such a big lie must be completely devoid of any iota of morality. It is a shame he is occupying a sacred office like CJP.

Totally agreed, not a single day passes when we see supreme court hearing nothing but a case against the govt. agreed that this is most corrupt govt ever seen but that does not mean a calling everyone to the court everyday, and any other case like Asghar Khan case will take the supreme court 15 years to start the hearing, if supreme court is so concerned about 600 million dollars of zardari then it also worried abot the 500 million dollar saif ur rehman took away while fleeing the country at the time of the coup.

  34. What all foreign media is saying about the judiciary and the chief justice is nothing but bullshit. Whenever any comment appears in international media, it never refers to the constitutional provisions or law of the land to substantiate their criticism. Flaying any judge or his judgment without making its relevance to the law and the constitution is mere stupidity that every critic needs to understand. An honest man is doing what is his duty and what he is bound as per law of the land. Why Western and Indian media has become much concerned after the judgment against Yousuf Raza Gillani demands a profound analysis of the whole situation. Just maligning will serve no purpose except to keep the independent judiciary under a pressure of the executive.
